The Secret Nobody Wants to Tell You If you want to get a Turkish Residence Permit or Citizenship by investment, you need to know a harsh reality. More than 95% of the houses you see on real estate websites are completely useless for your goals.

Why? Because the price you see on the internet and the price declared at the Title Deed (Tapu) office are almost always different. Even with the new "Real Value Law," many sellers and constructors hide the true price to avoid paying taxes.

The 5-Year Tax Trap Here is the biggest problem: Even if you agree to pay all the title deed fees, the seller will still refuse to declare the real value.

Why? Because of the Capital Gains Tax. If the seller bought the house less than 5 years ago, they probably declared a very low value back then. If they sell it to you at the real (high) price today, the government will see a massive profit on paper. The seller will be forced to pay millions of Liras in income tax!

It is the exact same with brand new buildings. Constructors show low costs in their accounting. Selling at the real value means huge taxes for them, so they refuse to do it.

The Only Safe Solution There is only one legal way out of this trap: You must find properties where the owner has held the title deed for more than 5 years. After 5 years, properties are tax-free for the seller. They can safely declare the real value. However, finding these specific, clean properties is like looking for a needle in a haystack.

DO NOT BE A VICTIM! Ordinary real estate agents will not tell you this. Their only goal is to get your signature and take their commission.

I have met so many foreign investors who were told, "Don't worry, it will be fine." They bought the house, but their citizenship or residence was rejected! Then, the same greedy agent says, "Okay, let's sell this one and buy you another house." You lose months or years of your life, while the agent makes commission three times from your misery.

Before looking at the official numbers, there is one crucial cultural rule you must understand: In Turkish real estate culture, the buyer usually pays for almost everything.

If you are purchasing a property, you are responsible for all transaction costs (except for any past property taxes owed by the seller). If you are selling your property, the buyer will traditionally cover these expenses.

The Most Important Pre-Check: Declare the Real Value Before starting the official process, both parties must explicitly agree to declare the real market value of the property at the title deed (Tapu) office.

  • If you are the buyer: You will cover the costs anyway, so there is no surprise.

  • If you are the seller: Declaring the real value will bring significant extra costs to your buyer. They must pay a 4% Title Deed fee (Tapu Harcı) based on the actual 3 Million TL value (which is 120,000 TL), plus a mandatory circulating capital fee (Döner Sermaye) for foreign transactions, which is approximately 30,000 TL in 2026.

It is vital to confirm these details at the very beginning. Buyers using bank loans spend a lot of time and money on upfront preparations. To prevent last-minute disagreements and wasted time, you must discuss all conditions openly and sign a written preliminary contract before making any payments.

Estimated Costs for BUYERS (2026 Regulations)

Here is a breakdown of the approximate expenses you will face when buying a property:

  • Official Sworn Translator: Minimum $100 (Required to attend the title deed office to translate the transaction for you).

  • Passport Translation: ~500 TL

  • Notary Approval for Passport Translation: ~2,500 TL

  • Power of Attorney + Sworn Translator: ~5,000 TL + $100 (Only required if someone else is handling the transaction on your behalf via proxy).

  • DASK Insurance: ~1,000 TL (Mandatory earthquake insurance required for every property transaction).

  • Real Estate Agent Commission: Officially, the law states it is 2% from the buyer and 2% from the seller. However, since most local sellers refuse to pay commission, it is standard practice for the buyer to cover the full 4%.

  • Foreign Exchange Spread (Döviz Alım Belgesi): By law, you must bring your funds into Turkey as foreign currency (such as USD). Your bank will convert this money to Turkish Lira through the Central Bank to issue your mandatory Foreign Exchange Document. You may experience a minor cost here due to the bank's exchange rate spread.

  • Real Estate Valuation Report: ~30,000 TL (As of 2026, this SPK-approved report is strictly mandatory for foreign buyers to verify the real value).

Estimated Costs for SELLERS

Selling a property involves much lower upfront costs. Your main responsibilities are:

  • Past Property Taxes (Emlak Vergisi): You must clear all outstanding property taxes at the local municipality before the title deed office allows the sale.

  • Passport & Translation Costs: You will need a notarized passport translation (~2,500 TL) and an official sworn translator at the title deed office if you do not speak fluent Turkish.

Aside from these minor paperwork fees, there are no heavy transaction costs for the seller under standard Turkish market conditions.

Getting your paperwork ready for a real estate transaction in Turkey can be complicated. For foreign buyers, gathering the purchasing documents can sometimes feel like "Mission Impossible."

The Foreigner's Dilemma If you do not have a bank account in Turkey, buying a property is incredibly difficult. You need a bank account to get the necessary financial papers for the purchase. But here is the problem: banks will ask you for a Residence Permit to open an account.

It is a frustrating dilemma. You want to buy a property to get a residence permit, but the bank wants a residence permit to let you open an account! Before You Buy: A Critical Warning

Before you start any official process or pay a deposit, you must investigate the property carefully. You need to make sure there are no legal problems attached to the house. Also, you must check for physical problems, especially hidden moisture or water leaks. Do not skip this step!

Required Documents for PURCHASING

When you are ready to buy, here is the list of documents you need:

  • Buyer’s ID / Passport: Original passport and a notarized Turkish translation.

  • Foreign Exchange Document (Döviz Alım Belgesi): This is the most important document for foreigners. It proves you brought foreign currency into the country.

  • Municipality Fair Value Certificate (Belediye Rayiç Belgesi): Shows the minimum tax value of the property.

  • Earthquake Insurance (DASK).

  • Temporary Turkish Tax Number.

  • Identity Declaration Form (Kimlik Beyan Belgesi): Must include a biometric photo.

  • Power of Attorney: Only if someone else is doing the process on your behalf.

  • Real Estate Valuation Report: This is mandatory for foreigners and must be prepared by an SPK-licensed valuation company.

  • Sworn Translator: You cannot use an ordinary translator at the title deed office. It must be an official sworn translator with their documents.

Required Documents for SELLING

If you are selling your property, you will need to prepare the following:

  • Your Passport: Original and notarized Turkish translation.

  • Your Turkish ID Card (Kimlik): Only if you have one.

  • Identity Declaration Form.

  • Power of Attorney: If you are authorizing someone else to sell it for you.

  • Sworn Translator: Required at the title deed office if you do not speak fluent Turkish.

  • Municipality Fair Value Certificate (Belediye Rayiç Belgesi): To get this, you must first pay all your past property taxes to the local municipality.

  • Bank Loan Application Document: If the buyer is using a bank mortgage, they will provide this.

  • Buyer’s ID.

(Note: If your spouse or children have a legal share in the property, all these documents are required for them as well.)

⚠️ IMPORTANT: The February 1st Rule Change

Everything changed after February 1st. Today, not everyone who says "I want to buy" is a real buyer.

Many buyers make a financial plan in their heads to avoid taxes. For example, if your house is worth 3 Million TL, they might say: "Let's declare the value as 1 Million TL at the Title Deed office, so I only pay 40,000 TL in tax."

This is no longer possible. The government's new system requires the real value to be declared.

If the real sale price is 3 Million TL, it must be declared as 3 Million TL. This means the Title Deed fee will be 120,000 TL. Because you are a foreign party, there is also a minimum 30,000 TL extra fee (Döner Sermaye).

This puts a 150,000 TL extra financial burden directly on the buyer. Because of these high, unavoidable costs, you might need to offer a slight discount on your asking price to successfully close the deal. Keep this in mind when negotiating!

 

⚠️ FINAL EXPERT ADVICE: Always Sign a Written Contract

Whether you are the buyer or the seller, never rely on just a verbal promise. Before any money changes hands, you must always sign a detailed preliminary sales agreement.

Here is why this is crucial for your safety:

  • The Cancellation Penalty: You must include a strict cancellation penalty (withdrawal fee) in the contract. If either the buyer or the seller suddenly changes their mind and walks away from the deal, this penalty guarantees that the other party is compensated. It protects both sides from losing valuable time and money.

  • No Surprises: Every single condition, payment detail, and timeline must be written down item by item. This ensures that everything is clearly discussed and agreed upon from day one. It leaves zero room for misunderstandings or "hidden rules" later.
